When can I make a claim for a slip, trip or fall at work?

Slipping and tripping are the single most common cause of major injury in UK workplaces. They are particularly dangerous because they can cause direct injury, as well as contributing to other types of incidents, including a fall from height or a machinery accident.

Employers have a strict legal responsibility to do all they can to prevent slips, trips and falls in the workplace. Therefore, if you believe your employer did not do everything they could to prevent your accident, you could be eligible to make a claim.

Every company needs to carry out risk assessments in the workplace to identify potential slip and trip hazards, including:

  • Trailing wires, cables or packaging
  • Water leaks and spillages
  • Cluttered working areas
  • Accumulation of rubbish and refuse
  • Raised areas of floors or platforms
  • Poor or malfunctioning lighting
  • Problems caused by weather conditions, such as rain, snow and ice

If the proper steps have not been taken to eliminate all of the risks presented by these hazards, they could be found guilty of failing to provide a safe working environment for staff, and you could therefore receive compensation for any injury you suffer as a result of this negligence.

How do I make a claim for a slip, trip or fall at work?

If you wish to make a compensation claim for a slip, trip or fall in the workplace, you will generally need to bring this claim within three years from the date of your accident, or since you received a relevant diagnosis.

Once the claim has been made, it will be necessary for you and your legal representative to prove that the accident occured due to someone else’s negligence. You can strengthen this case in the following ways:

  • Report the accident immediately and make sure it has been officially recorded by the company’s health and safety representative
  • Take photos of your injuries, as well as the area where the accident occurred
  • Obtain contact details for any witnesses to the accident itself, or who can confirm the existence of hazards or dangerous conditions
  • Keep records of all the medical visits and expenses that have followed as a result of the injury, and receipts for all related expenses

With all of this evidence in hand, it will be much easier for your solicitor to put together a strong case for compensation. Get in contact with a legal representative as soon as possible in order to talk through your options and work out the best way forward.

How much compensation will receive, and how long will it take?

There is no specific timeline or set amount of compensation you are likely to receive when making a slip, trip or fall at work claim. The final compensation payout will depend on the specific circumstances of your case, including:

  • The seriousness of the injury
  • The length of your recovery, and its impact on your life and career
  • Your future medical care requirements
  • Financial losses you have incurred or expect to incur as a result of the accident

Even when the evidence is on your side, you can expect the claims process to take several months at the very least, which is why it is important to seek legal advice as soon as possible. In many cases, it will be possible to obtain interim payments to cover your short-term needs.

Working with a solicitor on a no win, no fee basis may be the best option for many, as this will mean you will owe nothing if the claim is unsuccessful, and will still receive a healthy payout if you are able to make a successful claim.
